Facts

The children, two boys, were 7 and 6 respectively at the date of the alleged wrongful removal. Until then they had lived in Argentina all of their lives. The parents divorced in 1994 and the mother was awarded custody. However, under s. 264 (4) of the Argentinian Civil Code, even after a divorce, the agreement of both parents is required if children are to leave the country.

On July 8, 1996 the mother obtained an order from the Mendoza family court to take the children to the USA for a two week vacation. The mother did not return, instead she took the children to Germany. The father initiated criminal proceedings against the mother for child abduction in Argentina.

On 27 December 1996 of the Family Court in Mendoza granted the father custody of both children. The father then petitioned to the Family Court (Familiengericht) of Heilbronn for the return of the children under the Convention. The application was rejected on 4 March 1997 on the basis that the children would face a grave risk of psychological harm if sent back (Family Court (Familiengericht) of Heilbronn, 5 F 319/97).

The father appealed to the Higher Regional Court (OLG) of Stuttgart. On 26 May 1997 it upheld the appeal and ordered the return of the children, (Higher Regional Court (OLG) of Stuttgart, 17 UF 98/97). The mother petitioned the Federal Constitutional Court for leave to make a constitutional challenge.

Ruling

Leave for constitutional challenge rejected; it was for the Oberlandesgerichte and the Amtsgerichte to apply and interpret the provisions of the Convention.

Grounds

Rights of Custody - Art. 3

The court noted that “right of custody” in the context of the Convention includes all rights relating to the care of the person of the child (Personensorge), of which the right to determine the child´s place of residence is a very important element. Accordingly it held that ‘joint right of custody’ has to be understood as meaning that the removal of a child without the consent of the person who has the right to determine the place of residence of the child, but no other right of custody is also to be considered wrongful. If this were not the case, such a right to determine the place of residence could be easily undermined. The court ruled that such an interpretation is not contrary to German Constitutional Law, in particular not contrary to Art. 2(1) in connection with Art. 1(1), Art. 3(1), Art. 6(1-4) and Art. 11 of the Grundgesetz (German Basic Law).

The Supreme Court did draw a distinction between a non-removal clause in an interim custody order and in a final order. It suggested that were a non-removal clause in a final custody order to be regarded as a custody right for Convention purposes, that could have serious implications for the mobility rights of the primary carer.

The matter was settled, at least where an applicant parent has a right to decide the child's country of residence, or the court in the State of habitual residence is seeking to protect its own jurisdiction pending further decrees, by the US Supreme Court endorsing the standard international interpretation.

Right to Object to a Removal

Where an individual does not have a right of veto over the removal of a child from the jurisdiction, but merely a right to object and to apply to a court to prevent such a removal, it has been held in several jurisdictions that this is not enough to amount to a custody right for Convention purposes:

The European Court held that to find otherwise would be incompatible with the requirements of legal certainty and with the need to protect the rights and freedoms of others, notably those of the sole custodian.

Faits

Les enfants, deux garçons, étaient âgés de 7 et 6 ans à la date du déplacement dont le caractère illicite était allégué. Jusqu'alors, ils avaient toujours vécu en Argentine. Les parents avaient divorcé en 1994 et la mère avait obtenu la garde. Toutefois, l'article 264 (4) du code civil argentin exige le consentement des deux parents, même en cas de divorce, pour que les enfants puissent quitter le pays.

Le 8 juillet 1996, la mère obtint une décision du juge aux affaires familiales de Mendoza l'autorisant à se rentre aux Etats-Unis avec les enfants pour deux semaines de vacances. Au lieu de rentrer en Argentine, la mère emmena les enfants en Allemagne. Le père introduisit une demande pénale contre la mère, en Argentine, pour enlèvement d'enfant.

Le 27 décembre 1996, le juge aux affaires familiales de Mendoza confia la garde des deux enfants au père. Le père saisit ensuite le juge cantonnal (Amtsgericht) de Heilbronn d'une demande tendant au retour des enfants en application de la Convention. La demande fut rejetée le 4 mars 1997 au motif que les enfants seraient exposés à un risque grave de danger psychologique en cas de retour (Amtsgericht Heilbronn, 5F 319/97).

Le père interjeta appel devant la cour (Oberlandesgericht- OLG) de Stuttgart. Le 26 mai 1997, la cour d'appel infirma le jugement de première instance et ordonna le retour des enfants (OLG Stuttgart, 17 UF 98/97). La mère saisit la cour constitutionnelle fédérale d'une demande tendant à l'autoriser à exercer un recours constitutionnel.

Dispositif

Recours constitutionnel déclaré irrecevable; il revenait aux Oberlandesgerichte et aux Amtsgerichte d'appliquer et d'interpréter les dispositions de la Convention.

Motifs

Droit de garde - art. 3

Le juge constitutionnel indiqua que, au sens de la Convention, la notion de droit de garde inclut tous les droits relatifs aux soins de la personne de l'enfant (Personensorge), dont le droit de déterminer le lieu de résidence de l'enfant constitue un élément très important. Dès lors, il considéra que la notion de "droit de garde conjoint" devait être comprise comme impliquant que le déplacement d'un enfant sans le consentement du parent disposant du seul droit de déterminer son lieu de résidence s'analysait comme un déplacement illicite. Une interprétation différente conduirait à mésestimer facilement l'importance du droit de déterminer le lieu de résidence de l'enfant. Le tribunal constitutionnel indiqua qu'une telle interprétation ne heurte pas la loi fondamentale allemande, ne violant en particulier pas les articles 2 §1, conjointement aux articles 1 § 1, 3 § 1, 6 §1-4, et 11 de la loi fondamentale allemande (Grundgesetz, GG).

La notion de droit de garde au sens de la Convention

Les tribunaux d'un nombre très majoritaire d'États considèrent que le droit pour un parent de s'opposer à ce que l'enfant quitte le pays est un droit de garde au sens de la Convention. Voir :

La Cour suprême distingua néanmoins selon que le droit de veto avait été donné dans une décision provisoire ou définitive, suggérant que considérer un droit de veto accordé dans une décision définitive comme un droit de garde aurait d'importantes conséquences sur la mobilité du parent ayant la garde physique de l'enfant.

La Cour d'appel du 11ème ressort a néanmoins adopté l'approche majoritairement suivie à l'étranger.

La question a été tranchée, du moins lorsqu'il s'agit d'un parent demandeur qui a le droit de décider du lieu de résidence habituelle de son enfant ou bien lorsqu'un tribunal de l'État de résidence habituelle de l'enfant cherche à protéger sa propre compétence dans l'attente d'autres jugements, par la Court suprême des États-Unis d'Amérique qui a adopté l'approche suivie à l'étranger.

Droit de s'opposer à un déplacement

Quand un individu n'a pas de droit de veto sur le déplacement d'un enfant hors de son État de residence habituelle mais peut seulement s'y opposer et demander à un tribunal d'empêcher un tel déplacement, il a été considéré dans plusieurs juridictions que cela n'était pas suffisant pour constituer un droit de garde au sens de la Convention:

Cette interprétation a également été retenue par la Cour de justice de l'Union européenne:

La Cour de justice a jugé qu'une décision contraire serait incompatible avec les exigences de sécurité juridique et la nécessité de protéger les droits et libertés des autres personnes impliquées, notamment ceux du détenteur de la garde exclusive de l'enfant.

Hechos

Los menores, dos varones, tenían 7 y 6 respectivamente a la fecha de la supuesta sustracción ilícita. Hasta ese momento habían vivido en Argentina toda su vida. Los padres se divorciaron en 1994 y se le otorgó la custodia a la madre. Sin embargo, conforme al artículo 264(4) del Código Civil Argentino, incluso después del divorcio, se requiere el acuerdo de ambos padres si los menores deben abandonar el país.

El 8 de julio de 1996, la madre obtuvo una orden de un tribunal de familia de Mendoza para llevar a los menores a los EE.UU. de vacaciones durante dos semanas. La madre no regresó, en cambio se llevó los menores a Alemania. El padre inició acción penal contra la madre por sustracción de menores en Argentina.

El 27 de diciembre de 1996 el tribunal de Mendoza otorgó al padre la custodia de ambos hijos. El padre peticionó entonces ante el Amtsgericht (Tribunal de Primera Instancia) la restitución de los menores conforme a la Convenio. La solicitud fue rechazada el 4 de marzo de 1997 sobre la base de que los menores enfrentarían un grave riesgo psicológico si eran restituidos (Amtsgericht (Tribunal de Primera Instancia) de Heilbronn, 5 F 319/97).

El padre apeló ante el Oberlandesgericht (Tribunal Regional superior) de Stuttgart. El 26 de mayo de 1997 confirmó la apelación y ordenó la restitución de los menores, (Oberlandesgericht Corte Regional Superior) de Stuttgart, 17 UF 98/97). La madre solicitó al Tribunal Constitucional Federal permito para presentar una impugnación constitucional.

Fallo

Se rechaza la impugnación constitucional; correspondía al Oberlandesgerichte y al Amtsgerichte aplicar e interpretar las disposiciones del Convenio.

Fundamentos

Derechos de custodia - art. 3

El tribunal observó que el “derecho de custodia” en el contexto de la Convenio incluye todos los derechos relacionados con el cuidado de la persona del menor (Personensorge), del cual es un elemento muy importante el derecho a determinar el lugar de residencia del menor. En consecuencia, sostuvo que “derecho conjunto de custodia” debe ser entendido en el sentido de que el traslado de un menor sin el consentimiento de la persona que tiene el derecho a determinar el lugar de residencia del menor, pero ningún otro derecho de custodia también se considera ilícito. Si esto no era así, el derecho de determinar el lugar de residencia podía ser fácilmente socavado. El tribunal decidió que tal interpretación no es contraria a la Ley constitucional alemana, en particular no es contraria al Art. 2(1) en conexión con el Art. 1(1), Art. 3(1), Art. 6(1-4) y el Art. 11 de la Grundgesetz (Ley básica alemana).

La Corte Suprema estableció una distinción entre una cláusula de no traslado en una orden de custodia provisoria y en una orden definitiva. Sugirió que si una cláusula de no traslado incluida en una orden de custodia definitiva se considerara equivalente a un derecho de custodia a los fines del Convenio, ello tendría serias implicancias para los derechos de movilidad de la persona que ejerce el cuidado principal del menor.
