Facts

A 6-year-old boy (at the time of the decision) was born in the city of Salto, Eastern Republic of Uruguay. He lived there with his parents, who ended their relationship and entered into a court-approved agreement on custody, visitation rights and child support. The parents stipulated that they would share legal custody and authorised the child to travel with either of them to the Mercosur countries for a maximum of 15 days per trip. The mother would have physical custody.
The mother took the child from Uruguay to Paraguay and did not return upon the expiration of the agreed 15-day period.  
Upon the father’s request, the Head of the International Return Department of the State Secretary’s Office for Children and Teenagers of Uruguay requested the international return of the child. Return was refused by the Court in Childhood and Youth Matters of Caazapá, Paraguay, on 22 August 2018, on grounds of psychological and physical abuse endured by the mother of the child.
The father filed an appeal against the decision, which was granted and decided by the Court of Appeal in Childhood and Youth Matters of Paraguay.

Ruling

Appeal allowed; return ordered. The removal was not wrongful, but the retention was. No exceptions were proven.

Inter-American Convention on the International Return of Children

Habitual residence
The Court of Appeal in Childhood and Youth Matters of Paraguay found that the child’s habitual residence was in Uruguay.

Removal and retention
The Court of Appeal in Childhood and Youth Matters held that the removal of the child to Paraguay was not wrongful, given that the agreement signed by both parents allowed either of them to travel within Mercosur for 15 days without having to give notice to the other. However, the retention was wrongful because the mother did not return with the child after said period of time.
Thus, the Court found that the retention was wrongful due to the lack of authorisation and consent from the father allowing the child to stay in Paraguay.

Grave risk
The Court assessed whether there was a grave risk that the return would expose the child to psychological or physical danger or to an intolerable situation under the provisions of Art. 11(b) of the Inter-American Convention on the International Return of Children.
The Court pointed out that, to be able to refuse return on grounds of grave risk, the party opposing it must prove that such risk exists. It was considered that this requirement shows how rigorously the facts of a case must be assessed so as not to hinder the Convention’s efficacy.
The Court held that children must show a higher emotional disturbance than normal in the event of separation from one of the parents for the exception of Art. 11(b) of the Inter-American Convention on the International Return of Children to apply. Said emotional disturbance must be higher than the one normally caused by changes of residence.
In the case, the Court found that a grave risk had not been established, since all the evidence provided by the mother was aimed to demonstrate the father's inability to assume the parenting role. It was pointed out that this was a question relating to the merits of custody rights to be decided by the competent authorities of the State of the child's habitual residence. The Court therefore considered erroneous the decision of the first instance judge, who rejected the return on the basis of the Convention of Belem do Para and CEDAW.

Objections of the child to a return
The child was heard by the court of first instance, and he stated that he felt a little better in Paraguay than in Uruguay.
The Court held that the child’s statement was not a true objection under Article 11 of the Inter-American Convention and explained that the child’s objection against returning to the country of habitual residence must be strong and not a matter of mere preference.
It also pointed out that the age and level of maturity of children are measures used to assess their opinions in international return proceedings, pursuant to the principle of progressive autonomy. In this case, the young age of the child (6 years) militated against considering his opinion binding.

Issues Relating to Return

The Court of Appeal in Childhood and Youth Matters ordered the return and the deployment of means for the mother to accompany the child since she had physical custody.

Hechos

El niño, de 6 años de edad al momento de la sentencia, nació en la ciudad de Salto, República Oriental del Uruguay. Allí vivía con sus padres, quienes finalizaron su relación y suscribieron un convenio homologado judicialmente sobre la tenencia, visitas y pensión alimenticia. En el convenio se estableció que la guarda jurídica sería compartida por ambos padres, que la guarda material sería ejercida por la madre y que ambos padres autorizaban que su hijo menor viajara con cualquiera de ellos a los países del Mercosur por un plazo no mayor a 15 días.
La madre trasladó a su hijo desde Uruguay a Paraguay y no retornaron luego de que transcurrieran los 15 días que establecía el mencionado convenio.
A pedido del padre, la responsable de la Unidad de Restitución Internacional de la Secretaría Nacional de la Niñez solicitó la restitución internacional del niño, la cual fue rechazada por el Juez de la Niñez y Adolescencia de la Circunscripción Judicial de Caazapá, el 22 de agosto de 2018. El rechazo del pedido de restitución se fundamentó en la violencia psicológica y física sufrida por la madre del niño.
El padre dedujo recurso de apelación contra la resolución, el cual fue admitido y resuelto por el Tribunal de Apelación de la Niñez y Adolescencia.

Fallo

Apelación concedida, restitución ordenada. El traslado se consideró lícito, pero la retención ilícita. No se probó ninguna causal de excepción.

Fundamentos

Convención Interamericana sobre Restitución Internacional de Menores

Residencia habitual
El Tribunal de Apelación de la Niñez y Adolescencia entendió que la residencia habitual del niño se encontraba en Uruguay.

Traslado y retención
El Tribunal de Apelación de la Niñez y Adolescencia entendió que el traslado del niño a Paraguay fue lícito, dado que el acuerdo que habían firmado los padres permitía a cualquiera de ellos a realizar viajes dentro del Mercosur durante 15 días sin necesidad de aviso previo al otro progenitor. No obstante, la retención ha sido ilícita, debido a que la madre no retornó con el hijo luego de transcurrido el mencionado plazo.
Así, el Tribunal determinó que se configuraba un supuesto de retención ilícita debido a la falta de autorización y consentimiento del padre para que el niño permaneciera en Paraguay.

Grave riesgo
El Tribunal analizó si existía un riesgo grave de que la restitución exponga al niño a un peligro psíquico o físico o a una situación intolerable en los términos del artículo 11 b. de la Convención Interamericana sobre Restitución Internacional de Niños.
El Tribunal señaló que, para rechazar la restitución con fundamento en el grave riesgo, quien se opone debe probar con certeza que tal riesgo grave exista. Se consideró que esta exigencia revela el carácter riguroso con que debe evaluarse el material fáctico de la causa, a fin de no entorpecer la efectividad de la Convención.

Objeción del niño a la restitución
En primera instancia se produjo la escucha del niño, quien expresó que se sentía un poco mejor en Paraguay que en Uruguay.
El Tribunal entendió que esta declaración del niño no configuraba una verdadera oposición en los términos del artículo 11 de la Convención Interamericana. Explicó que la oposición del niño a regresar a su país de residencia habitual debe ser firme y no tratarse de una mera preferencia.
También se señaló que la edad y la madurez de los niños son medidas de valoración de las opiniones vertidas por ellos en los procesos de restitución internacional, conforme al principio de autonomía progresiva. En el caso, se consideró que la corta edad del niño (6 años) limitaba considerar y tornar vinculante su opinión.

Cuestiones relativas a la restitución

El Tribunal de Apelación de la Niñez y Adolescencia dispuso al ordenar la restitución que al ser la madre del niño quien tenía la guarda material, se debían arbitrar los medios para que acompañe al niño.
