Facts

The case is about a girl who lived in Spain. Her parents were separated, and on 10 April 2014 they entered into an agreement on the days the child would be with each of them, authorising the father to travel with the child once a year to Ecuador for no longer than a month.
On 11 August 2014, the father travelled to Ecuador with the child. They were due to return on 11 September 2014, but he decided not to return on the scheduled date.
On 17 September 2014, the mother requested the return of her daughter before the Spanish Central Authority. The request was sent to the Ecuadorian Central Authority, which received it on 28 February 2015 and forwarded it to Court.
On 15 December 2015, the Court of the Family and Children of El Oro (Ecuador) ordered the return of the girl to Spain, affirming that the retention had been wrongful. The father appealed.

Ruling

Appeal dismissed, return ordered.

Grounds

Habitual Residence - Art. 3

The Court found that the child’s habitual residence prior to the wrongful removal was in Spain.

Removal and Retention - Arts 3 and 12

The Court concluded that there was a wrongful retention in breach of the jointly exercised right of custody as the father and the child were duly authorised to travel to Ecuador, but they did not return to Spain within the agreed one-month period.

Settlement of the Child - Art. 12(2)

The Court considered that the requirements for the application of this article were not met as the claim before the Central Authority in Spain and its referral to the Central Authority in Ecuador and subsequent referral to court were initiated before the passage of a year since the wrongful retention, which had taken place in September 2014.

Grave Risk - Art. 13(1)(b)

The father alleged that before returning to Spain, the child stated that she had been sexually abused by her mother's partner; the father submitted as evidence the certificate of initiation of an urgent action before a prosecutor's office in Ecuador. The court considered that said evidence did not contribute to determining whether the abuse had taken place and thus did not amount to evidence of grave risk of harm. The court considered it was necessary to establish that the child had been exposed to acts detrimental to her integrity and/or that she could be exposed to an intolerable situation in the event of returning to Spain.

Procedural Matters

The Court considered that the father’s criminal complaint could not be disregarded, and therefore requested that before return, the Central Authority of Spain adopt the necessary measures to protect the psychological and physical integrity of the child upon her return to Spain. Moreover, the Court urged this entity and the National Secretary’s Office for the Migrant in Spain to follow up on the case to provide the father with the necessary logistical support, including legal assistance.
The father appealed the decision of the Provincial Court of El Oro, but the appeal was dismissed by the Constitutional Court of Ecuador in May 2017.

Hechos

El caso concierne a una niña que vivía en España. El 10 de abril de 2014, el padre y la madre, quienes se encontraban separados, acordaron mediante un convenio los días que la niña estaría con cada uno de ellos y una autorización para que el padre pudiera viajar con la niña a Ecuador una vez al año por un plazo máximo de un mes.
El 11 de agosto de 2014, el padre viajó con la niña a Ecuador, debiendo regresar el 11 de septiembre de 2014. Por decisión del padre no retornaron en la fecha prevista.
La madre de la niña solicitó la restitución internacional ante la Autoridad Central de España el 17 de septiembre de 2014. La solicitud fue transmitida a la Autoridad Central de Ecuador, que la recibió el 28 de febrero de 2015 y luego la remitió a la justicia.
El 15 de diciembre de 2015, el juez de la Unidad de Familia, Mujer, Niñez y Adolescencia de El Oro (Ecuador) ordenó la restitución de la niña a España dado que consideró ilícita su retención en Ecuador. El padre apeló la decisión.

Fallo

Apelación desestimada - restitución ordenada.

Fundamentos

Residencia habitual - art. 3

El tribunal entendió que la residencia habitual de la niña anterior al traslado ilícito se encontraba en España.

Traslado y retención - arts. 3 y 12

El tribunal concluyó que hubo una retención ilícita en infracción al derecho de custodia que se ejercía de forma conjunta ya que el padre y la niña viajaron a Ecuador con autorización, pero no regresaron a España dentro del plazo de un mes acordado.

Integración del niño - art. 12(2)

El tribunal consideró que no estaban reunidos los requisitos para la aplicación de este artículo ya que el reclamo ante la autoridad central de España, su derivación a la autoridad central ecuatoriana y su posterior remisión a sede judicial se iniciaron antes de cumplido el año desde la retención ilícita, que había ocurrido en septiembre de 2014.

Grave riesgo - art. 13(1)(b)

El padre alegó que, al momento de regresar a España, la niña manifestó que había sido abusada por la pareja de su madre y, a los efectos de demostrar este hecho en el proceso de restitución, acompañó la constancia de iniciación de un acto urgente ante una fiscalía de Ecuador. El tribunal entendió que esta diligencia no contribuía a determinar si había existido el abuso y, por ende, tampoco el grave riesgo. En este sentido, se consideró que era necesaria una verdadera demostración de que la niña había estado expuesta a actos lesivos a su integridad y/o que podría estar expuesta a una situación intolerable en caso de regresar a España.

Cuestiones procesales

El tribunal consideró que no podía dejar de tenerse en cuenta la denuncia realizada por el padre por lo que solicitó que, previo a su traslado a España, la Autoridad Central adopte todas las medidas necesarias para proteger la integridad física y psicológica de la niña. Asimismo, se conminó a esta entidad y a la Secretaría Nacional del Migrante con sede en España a dar seguimiento del caso a fin de que se provea al padre el apoyo logístico necesario, incluida la defensa técnica.
El padre de la niña presentó un recurso extraordinario contra la decisión de la Corte Provincial de El Oro que fue rechazada por la Corte Constitucional del Ecuador en mayo de 2017.
