This is a legal agreement between the user and the Permanent Bureau of the Hague Conference on Private International Law (hereinafter "Hague Conference") establishing the terms and conditions under which the International Child Abduction Database (INCADAT) may be used. Use of INCADAT implies your acceptance of these terms and conditions.
1. INCADAT consists of case summaries and full transcript texts. All intellectual property rights in the case summaries are owned by the Hague Conference. Reproduction of the case summaries is authorised for private use in the ordinary course of your business provided the source is duly acknowledged. Re-use, reproduction, publication or distribution of any part of INCADAT or the information contained within it for commercial purposes is strictly prohibited.
2. INCADAT is to be used as a reference tool and nothing provided herein should be used as a substitute for the advice of competent counsel.
3. The Hague Conference publishes these decisions with the consent of the appropriate public body. If applicable laws so determine, it is the responsibility of the public bodies providing these decisions to anonymise personal data before publication. The Hague Conference does not and can not censor the information provided.
4. The Hague Conference does not disclose or publish information which identifies individual users or the email addresses of individual users of INCADAT. Access to and use of this information is restricted to the Hague Conference.
5. While the Hague Conference makes every effort to ensure that information available on this site is updated and accurate, neither can be guaranteed. The information provided on this site is offered without any warranties, expressed or implied, including, without limitation, warranties of merchantability or fitness for a particular purpose. The Hague Conference will not be liable under any circumstances for any loss or damage suffered by reason of any defect in INCADAT. If errors or omissions are brought to the attention of the Hague Conference, we shall endeavour to correct them.
